Q Have I got to pay employees who can't get to work? A It depends. Hourly paid employees with no guaranteed hours who only get paid for the work they do are not entitled to be paid. For salaried employees the position is less clear-cut.

There is no case law on an employee failing to get in to work due to adverse weather. If they are "ready and willing" to work but are prevented by circumstances outside their control they should get paid. But is an employee who is unable to travel to work "ready and willing" or not? The general view is that they are not and so don't get paid. Acas guidelines advise that employees are not automatically entitled to pay if they are unable to get to work.
